2. Scope of the Service
Ruthless Evaluator is a professional SaaS platform providing automated analytical support for proposal evaluation processes.
The Service does not constitute legal advice, funding advice, regulatory advice, or official evaluation. No guarantee of funding outcomes or scoring results is provided.
3. Intended Users and B2B Nature
The Service is designed exclusively for professional and institutional use, including:
- Consultancies and advisory firms
- Universities and higher education institutions
- Research centres and public entities
- Innovation agencies
- Independent professionals acting in a professional capacity
The Service is not intended for consumer use.
4. Account Registration and Security
- Users must provide accurate registration information.
- Users are responsible for maintaining account confidentiality.
- Credentials must not be shared without authorization.
5. Acceptable Use
Users shall not:
- Use the Service for unlawful purposes.
- Attempt to reverse engineer or copy platform components.
- Interfere with infrastructure or security mechanisms.
- Upload malicious code or harmful content.
6. Data Protection Compliance
The Service operates in accordance with Regulation (EU) 2016/679 (General Data Protection Regulation – GDPR) and Spanish Organic Law 3/2018 (LOPDGDD).
Customers remain responsible for ensuring a lawful basis for the processing of personal data included in uploaded documents under Article 6 GDPR.
Where the Company processes personal data on behalf of customers, it acts as Data Processor within the meaning of Article 4(8) GDPR and processes such data exclusively on documented instructions from the customer.
The Service may rely on infrastructure and language processing providers operating within the European Economic Area and, where necessary, global infrastructure.
Where international transfers of personal data occur, appropriate safeguards in accordance with Chapter V GDPR are implemented.
7. Confidentiality Architecture
- Proposal drafts are processed transiently and deleted after evaluation completes, is cancelled, or fails.
- Structured evaluation outputs and limited technical metadata are stored for account functionality.
- Evaluation outputs are retained until deleted by the customer.
8. No AI Training Use
Submitted content is not used to train machine learning models and is not reused for external benchmarking or publication.
9. Intellectual Property
Users retain ownership of submitted content.
Generated outputs are licensed for internal professional use.
10. Fees and Subscription
Paid plans are governed by applicable subscription terms. Non payment may result in suspension.
11. Limitation of Liability
To the maximum extent permitted by law, liability is limited to the amount paid during the previous twelve months.
Nothing in these Terms limits liability where such limitation is prohibited by applicable law.
12. Termination
The Company may suspend or terminate access in case of breach of these Terms.
13. Governing Law and Jurisdiction
These Terms are governed by Spanish law.
Disputes shall be subject to the jurisdiction of Spanish courts.
